The Karnataka High Court on Friday came down heavily on Yenapoya University, Mangalore, for not complying with its orders and directed it to admit students selected by the Karnataka Examination Authority (KEA) for first-year medical course.
A Division Bench comprising Justie V. Gopala Gowda and Justice B.V. Nagaratna passed the order on petitions filed by Vasudha Sanklapur and others.
Students had moved the court after they were refused admission by Yenepoya University.
Several students, who had been allotted Government quota seats in deemed university, on Wednesday petitioned the Karnataka High Court, stating that the institution had refused to admit them for the first year medical course.
In their petition, Vasudha and four other students, said that they had been allotted medical seats in Yenepoya University by KEA after counselling. The High Court had on September 29, 2009 passed an order directing the institution to admit students sent to it by KEA. In spite of this direction, that varsity had refused them admission.
Varsity’s claim
The university claimed that it had misunderstood the operative portion of the order and there was no wilful disobedience of the order.
Advocate-General Ashok Harnahalli asked the court to initiate contempt proceedings against the varsity for refusing to comply with court orders. He pointed out that the High Court order was not interfered with by the Supreme Court.
The Bench said prima facie it was of the view that the institution had committed contempt of court. It once again directed the institution to admit students and adjourned further hearing of the case.
